Guardianship of Infants (Amendment) Bill 2025

The measure would let a court suspend a parent’s guardianship rights if that parent is convicted of murdering or manslaughtering the child’s other parent. It creates an immediate temporary suspension after conviction, with a route to a longer suspension through the Child and Family Agency and the District Court, and allows a Guardian ad Litem to represent the child’s views. It matters because it is designed to protect children after the death of a parent and to make sure decisions about their care are based on their welfare, not automatic legal rights.

Bill entitled an Act to provide for the suspension of the powers, responsibilities and entitlements of guardianship in certain circumstances and for that purpose to amend the Guardianship of Infants Act 1964 and to provide for related matters.
