Protection of Employees (Employers' Insolvency) (Amendment) Bill 2025

The proposal would strengthen protections for workers when their employer cannot pay its debts, especially by making sure more cases are covered under the State’s insolvency payments scheme. It would let the Minister treat some employers as insolvent even if they have closed without formally going through liquidation or bankruptcy, and it would also cover older cases that were left in a legal gap. It would clarify how wages, pension contributions and certain compensation awards are handled, and put the rules on salary caps and appeals on a clearer footing.

Bill entitled an Act to amend the Protection of Employees (Employers’ Insolvency) Act 1984; to give further effect to Directive 2008/94/EC of the European Parliament and of the Council of 22 October 2008 on the protection of employees in the event of the insolvency of their employer; to make provision for the deeming of employers to be insolvent in certain circumstances; to make further provision on the treatment of employees whose employer enters into an insolvency arrangement; to make further provision for the manner of calculation of certain payments made out of the Social Insurance Fund to certain employees in respect of insolvent employers; to amend the Employment Equality Act 1998; and to provide for related matters.
