Spiking Offences Bill 2026

Public bill · Private Member · Introduced

Spiking would become a separate crime, punishable by up to 10 years in prison, rather than being dealt with under existing poisoning rules. The proposal would also require arrangements for victims to access tests for drugs or other substances through Garda stations and health settings, to support their care and efforts to seek justice. It follows 278 reports of spiking to Gardaí between 2022 and 2025; none has led to a prosecution under the current rules.

Formal long title

Bill entitled an Act to make provisions for the offence of spiking to be considered a standalone offence; to establish toxicology pathways for victims of this offence; and to provide for related matters.
