Garda Síochána (Powers) Bill 2026

The Garda Síochána (Powers) Bill 2026 would create a single, updated framework for Garda stop-and-search powers, premises searches and access to data on phones, computers and other electronic systems. It would require clearer reasons and records for searches, court approval for accessing seized devices, protections for legally privileged material, and new urgent-search procedures. People in Garda custody would generally have the right to consult a solicitor before questioning and have one present, while serious-offence interviews would be electronically recorded. The measures aim to make investigations more effective while strengthening safeguards and accountability.

Formal long title

Bill entitled an Act to make provision in relation to the power of members of An Garda Síochána to stop and search persons and vehicles in specified circumstances; to make provision in relation to the search of premises; to make provision in relation to the treatment of persons in custody; to give further effect to Directive 2013/48/EU of the European Parliament and of the Council of 22 October 2013 on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities when deprived of liberty; to amend the Criminal Law Act 1976, the Criminal Justice (Miscellaneous Provisions) Act 1997 and the Criminal Justice Act 2007; and to provide for related matters.
