Michael Joe Cosgrave Mr. Cosgrave Question Fine Gael

170 Mr. Cosgrave asked the Minister for the Marine and Natural Resources if he is concerned with the reports that part of the Dún Laoghaire marina is in breach of a planning decision; the discussions which have taken place subsequently with the harbour board; if he has any proposals regarding the present situation; and if he will make a statement on the matter. Frank Fahey Minister for the Marine and Natural Resources (Mr. Fahey) Fianna Fáil

I am not aware that the marina as constructed breaches planning permission. If this is the case it is a matter between the harbour company and the planning authority. The first phase of the marina, which I recently opened, slightly exceeds the area allowed under the terms of the foreshore lease issued by my Department following approval by me. I am satisfied that this was not intentional and that it does not interfere with navigation or cause environmental problems. It is, therefore, purely a landlord and tenant issue and my Department has put certain proposals to the harbour company to deal with the matter and regularise the situation.
