The Part V of the Planning and Development Act 2000, applies to applicable developments of houses on any land that is zoned residential (either exclusively or mixed use) or is granted planning permission for houses as a material contravention of the development plan. Part V captures a portion of the increase in the land value when a local authority grants planning permission for residential development. It allows a local authority purchase a percentage of the land at less than the enhanced market value. Alternatively, it can also allow for a transfer of units built in lieu of the relevant portion of land.
Recognising the importance of this mechanism for the delivery of social housing, my Department is currently examining the potential scope of a review of the current Part V arrangements.
