Social Welfare Eligibility

Deputy Donna McGettigan asked the Minister for Social Protection the reason a person (details supplied) has been refused a social welfare payment despite being unemployed for the summer due to the seasonal nature of their work as a preschool teacher; and if he will make a statement on the matter. The person concerned submitted an application for Jobseeker’s Allowance on 3 July 2026. Following consideration of all available information, a decision was made on 9 July 2026 to disallow the claim.

The claim was disallowed on the grounds that the person's assessable means exceed the maximum rate of Jobseeker’s Allowance payable in respect of their family circumstances. In this case, the maximum weekly rate payable is €480.60, while the person's weekly means were assessed at €516. The assessed means arise from the earnings of the person's spouse.

A review of the means assessment was subsequently carried out on 23 July 2026. Following this review, it was determined that there was no change in the person's circumstances that would warrant a revision of the original decision, and the disallowance stands. This case has now been forwarded to the Social Welfare Appeals Office for decision and that Office will be in touch in due course.

My Department also considered whether the person concerned has an entitlement to Jobseeker's Benefit. Unfortunately the person concerned does not have required PRSI contributions in the Governing Contribution Year.
