Deputy Michael Healy-Rae asked the Minister for Justice, Home Affairs and Migration if he will advise whether his Department is currently drafting a new explosives bill or is considering amendments to the existing explosives legislation (details supplied); and if he will make a statement on the matter. The General Scheme of an Explosives Bill was approved by Government in 2008. The aim of the General Scheme was to repeal the Explosives Act 1875 and replace it with a modern statutory framework for the control of the manufacture, storage, importation, transport and supply of explosives.
This Bill would also provide for the reloading of ammunition by competent persons who are firearms dealers or licensed firearms holders under strict licensing and regulatory conditions.
As you are aware, current Government policy is that, as a general rule, the reloading of ammunition by private individuals is not permitted. However, in certain circumstances it can be permitted where it is part of an approved pilot project. In order to be considered for a pilot project, it is necessary to submit a business case to my Department.
In August 2023, my Department received sanction from the Department of Public Expenditure and Reform for an independent review of explosives legislation, including the above Bill, to be conducted by retired civil servant Ms Marion Walsh.
That report was completed in April 2024 and presented to my Department in June 2024, and the status of the Bill continues to be kept under review.
