2339. Deputy Marian Harkin asked the Minister for Justice, Home Affairs and Migration if there is a mechanism under Irish immigration law by which a non-EEA national resident in Ireland on a Stamp 1G dependant visa can be granted permission to commence trading. [57806/26]

I propose to take Questions Nos. 2339, 2340 and 2341 together.

Spouses, de facto partners or minor children of Critical Skills Employment Permit, General Employment Permit or Intra-Company Transfer Employment Permit holders, or researchers on a Hosting Agreement, are granted a Stamp 1G immigration permission upon satisfying the relevant criteria.

Such holders of a Stamp 1G permission are permitted to work and undertake a course of study in the State, but are not permitted to establish or operate a business. I can advise the Deputy that after five years on a Stamp 1G permission as a dependent, these individuals may be eligible for a Stamp 4 permission, which permits the holder to establish and operate a business in the State.

It is also open to any person to apply for a change of immigration status if they meet the criteria for doing so.
