Deputy Emer Currie asked the Minister for Health the expected implementation timeline for each individual provision of the Public Health (Tobacco Products and Nicotine Inhaling Products) (Amendment) Bill 2026 following its anticipated passage through the Houses of the Oireachtas; whether all provisions are intended to be commenced simultaneously or on a phased basis; and if she will make a statement on the matter. The draft Public Health (Tobacco Products and Nicotine Inhaling Products) (Amendment) Bill 2026 generally provides that the Act shall come into operation on such day or days as the Minister may appoint. I intend to commence the Act as soon as possible should it be passed by the Oireachtas.

Section 21 amends the 2023 Act to insert provisions regulating the packaging, appearance and flavour names of nicotine inhaling products, and provides that these shall not apply to the sale of nicotine inhaling products for 12 months following commencement of Section 21. This is to provide a wash-through period for manufacturers, importers and retailers to modify products and clear non-compliant stock.

The final content of the legislation is a matter for the Oireachtas.
