Deputy Robert Troy asked the Minister for Transport the rules in place to restrict the warning signage which can be in place on commercial or agricultural vehicles; and if there are specific measures and restrictions in place to ensure warning amber lights are not excessive and causing visibility issues for oncoming traffic. As Minister of State for International and Road Transport, Logistics, Rail and Ports, I wish to advise that there are no specific warning signage requirements for commercial or agricultural vehicles.
Commercial vehicles may use signage warning of blind spots and caution for cyclists or pedestrians when the vehicle is turning left.
The standards and requirements for agricultural tractors using amber lights are set out in S.I. No. 639/2020 - Road Traffic (Lighting of Vehicles) (Amendment) Regulations 2020 (www.irishstatutebook.ie/eli/2020/si/639/made/en/print).
In addition, the following two regulations provide for the issuing of special permits for particular commercial vehicles in certain circumstances. The Road Traffic Act, 1961, Section 13 (www.irishstatutebook.ie/eli/1961/act/24/section/13/enacted/en/html#sec13) allows regulations to be made for special permits for particular vehicles.
The Road Traffic (Special Permits for Particular Vehicles) Regulations - S.I. No. 283/2007 (www.irishstatutebook.ie/eli/2007/si/283/made/en/) prescribes the regulatory framework for the issue of special permits by local authorities authorising particular vehicles or combinations of vehicles which contravene the Road Traffic (Construction and Use of Vehicles) Regulations 2003 – S.I. No. 5 of 2003 (www.irishstatutebook.ie/eli/2003/si/5/made/en/print) to be used on public roads notwithstanding the contraventions. An abnormal load is a load that exceeds the weight, height, width, or length limit(s) outlined in S.I 5/2003.
The Road Traffic (Specialised Vehicle Permits) Regulations 2009 - S.I. No. 147/2009 (www.irishstatutebook.ie/eli/2009/si/147/made/en/print?q=147&years=2009) introduce a streamlined permit system to be administered by An Garda Síochána for the movement of wide and long vehicles (including loads) not exceeding 27.4 metres in length and 4.3 metres in width on the major interurban routes
The operation of amber lights outside of these regulations should be reported to An Garda Síochána, who are the enforcement authority.
