Deputy Cormac Devlin asked the Minister for Climate, Energy and the Environment the body which will operate the register of producers required under Regulation (EU) 2025/40; the date on which that register will open for registration; the fee structure proposed for producers placing less than ten tonnes of packaging on the Irish market annually; whether the simplified reporting dataset provided for under that Regulation will be applied in the State; and if he will make a statement on the matter. Article 44 of the EU’s Packaging and Packaging Waste Regulation (PPWR) provides for the establishment of a national register of packaging producers. While the requirement to establish a producer register is new, the measure has not yet come into force.

The European Commission is currently developing an Implementing Act setting out the format and requirements for the producer register, and a public consultation through the Commission's "Have Your Say" portal is open until 10 September at this link https://ec.europa.eu/info/law/better-regulation/have-your-say/initiatives/15352-Packaging-and-packaging-waste-rules-on-national-registers-of-producers_en.

Importantly, the requirements for a producer register under Article 44 will not apply until 18 months after this Implementing Act enters into force. As the Implementing Act has not yet been adopted, the producer registration requirements are unlikely to take effect before late 2027 or early 2028.

The PPWR does provide for lower reporting obligations for producers placing less than 10 tonnes of packaging on the market in a calendar year. Ireland's producer register to be established under Article 44 will take full account of any such provisions available.
