Social Welfare Payments
2016. Deputy Paul McAuliffe asked the Minister for Social Protection to ensure the disability allowance payment of a person (details supplied) is continued without any issues following a request for additional information from the Department, whilst the payment was initially reinstated in May 2026. Disability Allowance (DA) is a weekly means-tested payment available to people aged 16 years and over and under 66 years of age who have a specified disability that is expected to last for at least one year. Entitlement to DA is subject to the person satisfying the medical qualifying conditions, a means test, and the habitual residence condition.
The Department periodically reviews claims in payment to ensure that recipients continue to satisfy the qualifying conditions of the scheme.
Following a review of the means of the person concerned, it was determined that they had nil means and continued to satisfy the means conditions for Disability Allowance. The person concerned was notified of this decision on 14 May 2026 and was advised of the reasons for the decision, together with their right to seek a review and/or appeal.
On 22 June 2026, the Department commenced a review of the person's ongoing medical eligibility for Disability Allowance. As part of this process, a self-assessment Medical Review form (MR99) was issued for completion and return. The completed form was received by the Department on 3 July 2026.
Following examination of the information provided, a further medical review form (MR33), to be completed by the person's treating doctor, was issued with a request that it be returned within 21 days. To date, the completed MR33 form has not been received by the Department.
The person concerned will now be afforded a further 21 days in which to submit the outstanding medical information. Once received, the information will be considered by the Department's Medical Assessor and Medical Decisions Team to determine whether the medical qualifying conditions for Disability Allowance continue to be satisfied.
