I propose to take Questions Nos. 2206 and 2207 together.
The European Commission monitors the application of EU law in the Member States and may initiate infringement proceedings if a Member State fails to transpose an EU directive into national law by the prescribed deadline. The infringement procedure follows several steps laid out in the EU treaties (Article 258 of the TFEU), each ending with a formal decision.
If an EU Member State fails to transpose or communicate a complete transposition to the Commission following a reasoned opinion, the Commission may refer the matter to the Court of Justice of the European Union (CJEU) to confirm the principle of the infringement and propose that the court impose financial penalties.
In March 2026, the Minister of State for European Affairs and Defence, Thomas Byrne TD, launched an EU law transparency initiative with a dedicated section on Ireland.ie focused on highlighting how Ireland implements EU law. Details of infringement proceedings against Ireland are listed. Details of directives which are due to be transposed into Irish law this year are also included in this section. The following table provides details of measures under the remit of my Department which have a transposition date since 1 January 2023. No financial penalties have arisen in respect of the late transposition of measures under the remit of my Department during that timeframe.
