62. Deputy Ken O'Flynn asked the Minister for Foreign Affairs and Trade the specific statutory provision which permits the Passport Service to dispense with guardian consent for a passport application where the applicant is under 18 and married; and if this exception remains legally applicable to a person under 18 who is married under Irish law. Deputy Ken O'Flynn asked the Minister for Foreign Affairs and Trade whether a person under 18 who is legally married in another jurisdiction may apply for an Irish passport without guardian consent under the Passport Service's current guidance; if so, the legal basis for this; and whether her Department distinguishes between a marriage legally recognised in Ireland and a marriage entered into in another jurisdiction for this purpose. Since the introduction of the Domestic Violence Act, 2018, which repealed the exemptions for underage marriage in Section 33 of the Family Law Act, 1995, the Passport Service has not processed any applications from applicants who are under the age of 18 and are married, without the consent of their guardian(s).
