My Department always adheres to the principles of competitive tendering when procuring goods and services. This is a requirement of EU law under the EU Public Procurement Directives. A fundamental objective of these procedures is to ensure fair and open competition between suppliers through the submission of tenders following the advertisement of procurement opportunities on the eTenders platform and, where applicable, in the Official Journal of the European Union (OJEU). Such competitions are open to all eligible suppliers, subject to applicable EU and UN sanctions and restrictions.
The Department has an existing licence agreement with the company (details supplied) procured in 2003 and undertaken in accordance with the applicable public procurement requirements in place at that time.
I have referred the Deputy’s question to the agencies under the remit of my Department for direct reply. Please advise my private office if you do not receive a reply within ten working days.
