The Department upheld the parcels’ ineligibility due to lack of independent access, but the farmer may appeal or submit evidence of newly established legal access.
1006. Deputy John Paul O'Shea asked the Minister for Agriculture, Food and the Marine if a field inspection can be carried out to confirm access to two parcels of land declared and actively farmed by a farmer in County Kerry (details supplied) for a 2026 BISS payment. [65750/26]

The lands mentioned above were previously found to be ineligible due to the lack of independent access to the land and a review carried out on this decision by my Department has upheld the original decision. The applicant has been advised of their right to make an appeal through the independent Agriculture Appeals Office. If the applicant has now established a legal right to access the land in question for the 2026 claim year, they or their agricultural advisor should contact my Department to submit that evidence.
