The Minister affirmed that the LGBTIQ+ Inclusion Strategy does not override statutory child-protection duties, with children’s safety and welfare remaining paramount.

Deputy Carol Nolan asked the Minister for Children, Disability and Equality if she will clarify whether the National LGBTIQ+ Inclusion Strategy can override or qualify statutory child protection obligations; her views on the primacy of safeguarding duties in all publicly funded services involving infants; and if she will make a statement on the matter. The Government is committed to advancing equality and inclusion for LGBTIQ+ people and to ensuring the highest standards of child safeguarding. The aim of the National LGBTIQ+ Inclusion Strategy II 2024 - 2028 is to promote equality and inclusion for LGBTIQ+ people. It does not override or qualify any statutory obligations, including those relating to child protection and welfare.

All Tusla registered early years services are required to comply with the relevant legislative and regulatory requirements governing child safeguarding. The safety, welfare and best interests of children remain paramount, and organisations providing services to children must fulfil their responsibilities under the Children First Act 2015 and associated Children First National Guidance.
