The response to the correspondence raised (ref: DCDE-MFO-01419-2026), refers, amongst other things, to a number of reviews, proposed or in progress, of certain protocols, as well as proposed amendments to the Child Care Act.

Regarding the review of the Missing Children in Care Joint Protocol, as advised in correspondence, Tusla and An Garda Síochána respond to all missing from care incidents under the Missing Children in Care Joint Protocol, which is currently under review. Revisions to the protocol are still in development, and under discussion with all parties working to finalise and agree a revised protocol. I understand that the revised Missing Children from Care (MCIC) Protocol is currently with An Garda Síochána for approval.

The Tusla Child Sexual Exploitation (CSE) Procedure is a national child protection procedure developed by Tusla, with support from An Garda Síochána, to help professionals identify, assess, report, and respond to children who may be victims of sexual exploitation. It has been in place since 2021 and is subject to ongoing review to consider how it is working and consider what improvements may be made. A revised Tusla Child Sexual Abuse Exploitation (CSE) procedure is due for completion by the end of 2026.

The Programme for Government 2025, Securing Ireland's Future, made a commitment to update the Child Care Act, 1991. The Child Care (Amendment) Bill 2025 has been published. The amendments in this Bill will support Tusla to deliver more effectively on its duties to children and families. The Bill will introduce guiding principles to strengthen the child-centred focus of the Act and to foreground the best interests of the child. It contains new measures to strengthen inter-agency co-operation and national coordination on child protection. Designated public bodies will be required to proactively share information and collaborate to deliver more coordinated and effective services. Dáil Second Stage of the Bill took place on 27 and 29 January 2026 and the Bill has been referred to Committee Stage. Committee Stage of the Bill will be scheduled upon finalisation of amendments to the Bill to place the National Review Panel on a statutory footing. Subject to the completion of the legislative process, it is my intention that the relevant provisions will be commenced as soon as practicable following enactment.
