Public Procurement Contracts

Summary

There is no central database for contractor performance, post-award amendments or their cumulative value, so the Department cannot provide the requested figures. Individual contracting authorities manage and record contract changes and supplier performance; eTenders does not hold this post-award information.

224. Deputy Carol Nolan asked the Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation whether the State maintains a central database recording contractor performance across contracting authorities. [75168/26]

Jack Chambers Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation Fianna Fáil

I propose to take Questions Nos. 224, 230, 231, 232 and 233 together.

There is currently no central database maintained by my Department or by the Office of Government Procurement that records all post-award contract amendments, cumulative increases in contract values arising from such amendments, or contractor performance across all contracting authorities. Responsibility for the management of contracts, including the approval and recording of contract modifications and the monitoring of contractor performance, rests with individual contracting authorities.

Consequently, my Department does not hold centrally compiled information on:

• the total number of public contracts amended in each of the past five years;

• the number of contracts for which cumulative amendments exceeded 10 per cent, 25 per cent or 50 per cent of the original contract value; or

• cumulative contract value increases arising from post-award modifications.

Contracting authorities must ensure that modifications comply with the relevant provisions of public procurement legislation and maintain appropriate records as part of their contract management and governance arrangements.

Similarly, there is no central National database recording contractor performance across all contracting authorities. Individual contracting authorities are responsible for contract management and may maintain supplier performance records for their own operational, governance and procurement purposes. The eTenders platform provides transparency regarding procurement opportunities and contract award notices but is not designed as a central repository for contractor performance information or contract management data following contract award.

The Government continues to support transparency, accountability and value for money in public procurement through the development of procurement policy, guidance and reporting arrangements. However, the detailed management of individual contracts and any amendments remain a matter for the individual contracting authority.
