Immigration Policy

Summary

The Minister said applicants must meet six months’ employment immediately before 30 September 2026 and remain employed; criteria will not change, while temporary protection continues.

349. Deputy Paul Murphy asked the Minister for Justice, Home Affairs and Migration if the six-month employment requirement under the temporary protection transition scheme must in all cases have been completed immediately prior to 30 September 2026; the reason the qualifying period was fixed by reference to 30 September 2026 when the earlier published information did not clearly identify 30 March 2026 as a qualifying cut-off date; if he has considered assessing the six-month employment requirement by reference to the date on which an applicant applies; and if discretion is available for short and documented breaks in employment (details supplied). Full details of the Temporary Protection Transition Scheme, including eligibility requirements, are available online at A New Permission (EN). www.gov.ie/en/department-of-justice-home-affairs-and-migration/collections/a-new-permission-en/

The eligibility requirements of the scheme are set out at section 4.1 of the Scheme Policy document.

Individual Applicants and Principal Applicants on behalf of families must be in employment or self-employment for six months with average gross earnings of €29,432 per year immediately prior to the opening date for this Scheme i.e. 30 September 2026 and continue to be in employment at the date of application and at the date of decision. It is not intended to review the eligibility requirements of the scheme.

It is important to note that the Temporary Protection Transition Scheme is not intended to replace Temporary Protection, but to provide an additional pathway for those who are eligible and who wish to remain in Ireland on an independent basis. Persons who do not satisfy the eligibility criteria will continue to benefit from Temporary Protection and its associated rights and entitlements while the Temporary Protection Directive remains in effect. Temporary Protection is currently in place across the EU until March 2028. People in Ireland will continue to have access to the associated rights of the Directive for the duration of Temporary Protection to include the right to reside in Ireland and the right to access to social welfare, education, and employment.
