Deputy Sinéad Gibney asked the Minister for Justice, Home Affairs and Migration the number of cases taken, and successful prosecutions, under the Prohibition of Incitement to Hatred Act 1989 and the Criminal Justice (Terrorist Offences) Act 2005 since enactment, broken down by year, in tabular form; and if he will make a statement on the matter. The management of the courts, operational matters and logistical functions are the responsibility of the judiciary and Courts Service, which are independent in exercising their functions under the Courts Service Act 1998 and the Constitution. As Minister, I have no role in these matters.
It should be noted that the Department does not record data relating to convictions, as this is a function of the courts.
