Legislative Measures

1045. Deputy Sinéad Gibney asked the Minister for Enterprise, Tourism and Employment whether his Department will consider introducing legislation to ensure money held by ticket platforms for live music events and festivals is held on trust for the event and festival operators, similar to the arrangements for auctioneers when acting as an intermediary to a sale; and if he will make a statement on the matter. While I acknowledge the concerns underpinning this proposal, Irish insolvency law provides an established framework for the treatment and distribution of assets among creditors and other affected parties.

My officials contacted the CCPC who noted the following:

While the CCPC has made submissions to the Government and the European Commission on the sale and advertising of event tickets (most recently, the CCPC’s submission to the European Commission’s consultation), segregated accounts have not been an area of advocacy for the CCPC. Such accounts are a requirement for businesses in certain sectors that are subject to sectoral regulation which is not currently the case for ticketing companies.

The CCPC will continue to monitor developments in the ticketing sector within its consumer protection and competition enforcement remit. Should evidence arise of practices that give rise to concerns under the relevant legislation, the CCPC will consider the appropriate course of action.
